    Trump Orders Investigation into Biden’s Alleged Use of Autopen

    President Donald Trump has ordered an investigation into the alleged use of an autopen to sign pardons under the Biden administration without the former president’s knowledge. “In recent months, it has become increasingly apparent that former President Biden’s aides abused the power of Presidential signatures through the use of an autopen to conceal Biden’s cognitive decline and assert Article II authority,” the presidential memorandum says. “This conspiracy marks one of the most dangerous and concerning scandals in American history.” Though Biden appeared to suffer from cognitive decline, the White House issued more than 1,200 presidential documents, appointed 235 federal judges to the Federal bench, and issued many pardons and commutations. Shortly before Christmas 2024, Biden commuted the sentences of 37 death row criminals. Trump ordered an investigation into activity designed to hide Biden’s health from the public, agreements between Biden aides to elevate the former president’s abilities, and the circumstances around Biden’s executive actions during his final years in office, particularly policy documents signed with autopen. “Given clear indications that President Biden lacked the capacity to exercise his Presidential authority, if his advisors secretly used the mechanical signature pen to conceal this incapacity, while taking radical executive actions all in his name,” the memo says, “that would constitute an unconstitutional wielding of the power of the Presidency, a circumstance that would have implications for the legality and validity of numerous executive actions undertaken in Biden’s name.” Biden responded to the investigation Wednesday night. “Let me be clear: I made the decisions during my presidency.     Trump admin strikes down controversial Biden-era abortion mandate

    The Trump administration rolled back a controversial Biden-era policy Tuesday that aimed to force emergency room doctors to perform abortions under the Emergency Medical Treatment and Labor Act (EMTALA), drawing praise from pro-life leaders and religious liberty advocates. The Department of Health and Human Services (HHS) and Center for Medicare and Medicaid Services (CMS) announced the reversal in a press release, framing it as a move to protect both pregnant women and their unborn children. “CMS will continue to enforce EMTALA, which protects all individuals who present to a hospital emergency department seeking examination or treatment, including for identified emergency medical conditions that place the health of a pregnant woman or her unborn child in serious jeopardy,” the agency stated. “CMS will work to rectify any perceived legal confusion and instability created by the former administration’s actions.” The previous Biden-era policy, issued in July 2022 by then-HHS Secretary Xavier Becerra, required doctors to perform abortions if they deemed the procedure necessary to stabilize a patient — even if it violated state pro-life laws or the doctor’s convictions. In response, the Alliance Defending Freedom (ADF) filed a lawsuit earlier this year on behalf of the Catholic Medical Association, which argued that the mandate was a violation of conscience rights. Following Tuesday’s announcement, ADF announced it was dropping the case, while praising the move as a win for doctors. “Doctors—especially in emergency rooms—are tasked with preserving life,” said ADF Senior Counsel Matt Bowman. “The Trump administration has rolled back a harmful Biden-era mandate that compelled doctors to end unborn lives, in violation of their deeply held beliefs.”  Bowman emphasized that all 50 states already permit doctors to treat life-threatening conditions like ectopic pregnancies. “Emergency room physicians can and do treat life-threatening conditions such as ectopic pregnancies, and every state allows doctors to do whatever is necessary to preserve the life of a mother,” he said. “Now, doctors will be able to perform their life-giving duties without fear of government officials forcing them to end life and violate their beliefs.” Susan B. Anthony (SBA) Pro-Life America also celebrated the move.  “Led by Dr. Oz, the Trump administration has delivered another win for life and truth – stopping Biden’s attack on emergency care for both pregnant moms and their unborn children,” said SBA Pro-Life President Marjorie Dannenfelser.     President Joe Biden’s lax immigration enforcement and open borders policies made this country highly vulnerable to acts of terrorism. One of the big lessons of this weekend’s anti-Semitic Molotov cocktail and flamethrower attack in Boulder, Colorado by Egyptian national Mohamad Soliman, is how vulnerable we’ve made ourselves to infiltration by foreigners looking to do violence or acts of espionage. That can be in the form of lone wolf ideologues, terrorist cells, or well-coordinated actors from hostile foreign governments and organizations. As more details emerge about Soliman, a picture is emerging of a man who should never have been allowed in the country and flagrantly abused our immigration system once he was here. “Soliman came to the U.S. on a tourist visa in August 2022, according to a source from the Department of Homeland Security,” News Nation reported. “One month later, he applied for asylum. Soliman, his wife and their five children have been living in Colorado Springs, Colorado, since.” Soliman was reportedly granted a work permit in 2023, but it expired in March. Soliman’s wife and five children were taken into ICE custody Tuesday. Some have called this threat overblown, but that notion should be gone after Sunday. How many more people like Soliman, radicalized by the Israel-Gaza conflict, are still living in the U.S., potentially plotting other acts of violence? There are certainly signs that other people willing to commit similar acts of terrorism have come into the country over the last four years. The House Judiciary Committee released a report in August indicating the Biden administration released 99 potential terrorists into the country since January 2021. “Under President Joe Biden and Vice President Kamala Harris, of the more than 250 illegal aliens on the terrorist watchlist who were encountered by Border Patrol at the southwest border between fiscal years 2021 and 2023, the Department of Homeland Security (DHS) released nearly 100 of them, with at least 34 others in DHS custody but not yet removed from the United States,” the committee said in a press release. Illegal aliens came from a total of 36 countries, the report says, with an “active” terrorist presence, “including Afghanistan, Egypt, Iraq, Kyrgyzstan, Lebanon, Mauritania, Pakistan, Russia, Somalia, Sri Lanka, Syria, Tajikistan, Turkey, Uzbekistan, and Yemen.” Notice that Soliman’s home country of Egypt is on that list. How many more potential, foreign-born terrorists are lurking in America? In 2024, the Department of Homeland Security, “identified over 400 immigrants from Central Asia and elsewhere who crossed into the U.S. in the past three years as ‘subjects of concern’ because they were brought by an ISIS-affiliated human smuggling network,” NBC reported last June. Eight Tajikistan nationals with suspected ties to the Islamic State were arrested that month, but as the Immigration and Customs Enforcement director told The Daily Signal’s Virginia Allen at the time, this didn’t solve the problem. Not only were there likely many people in the U.S. connected to terrorist groups, but the vetting process made it difficult to ensure that the people brought in “legally” weren’t a danger to Americans. “Thousands of terrorists in the world are not found in any database,” Homan told The Daily Signal last June. “That is why we need to end catch and release and reestablish the ‘Remain in Mexico’ [policy].” Looks like Homan was onto something. Even former FBI Director Christopher Wray admitted in 2023 that the border crisis was opening the U.S. to the potential for an escalation of terrorism. He said of terrorists at a Senate hearing: Obviously, their ability to exploit any port of entry, including our southwest border, is a source of concern. There is a lot of discussion about numbers, and numbers are important. But let’s not forget that it didn’t take a big number of people on 9/11 to kill 3,000 people. While numbers are important, numbers don’t tell the whole story. And we have seen an increase in KST, known or suspected terrorists, attempting to cross over the last five years. Given the potential for deadly attacks on American citizens it seems like security should have been heightened, that visa vetting should have been aggressive. The Trump administration is turning things around on that end and clearly prioritizing American security. But after four years of open borders nonsense and courts that want to continue those policies as long as possible, this problem can’t be solved overnight.   The far Left wants to “globalize the intifada.” Some of those who wish to do violence are home grown. But Biden’s border policies gave them a massive opening to magnify the threat on American soil. Shameful. It’s a good reminder the problem with Biden was about much more than just his poor health and mental condition. He was asked to sign his first executive order, and muttered, “Why do I always get stuck signing for the lunch tab?” They sent for me immediately. TDS: Did you see his cognitive decline? OTTO: Me, personally? The whole point of a White House autopen is that the president doesn’t have to be around. However, Mr. Joe did accidentally wander in enough times for me to get the full picture.     MSNBC's Ratings Plummet Even Further After Jen Psaki Moves to Primetime: Report

    MSNBC's ratings and viewership have kept tumbling after the left-wing network revamped its primetime lineup this month, with former Biden press secretary Jen Psaki taking over host Rachel Maddow's coveted 9 p.m. slot, according to the Daily Mail. In the crucial 25-54 age demographic, MSNBC has seen its ratings plunge 41 percent during primetime and 34 percent across the total broadcast day compared with a year ago, according to rating figures leaked to the Daily Mail. Psaki's show, The Briefing, has since averaged 973,000 total viewers, down 46 percent from Maddow's numbers earlier this year. On May 7, a day after Psaki took over Maddow's time slot on Tuesdays through Fridays, the network's demo viewership tanked from 139,000 to 65,000—a 53 percent drop, Fox News reported earlier this month. The slump comes after MSNBC has already faced plummeting ratings and viewership for months amid mounting scrutiny over the network's left-wing bias in its coverage. MSNBC's parent company, Comcast, announced in November that it was cutting ties with the failing network. Psaki, for her part, has faced backlash over her role in covering up former president Joe Biden's mental decline. Her May 22 broadcast drew 973,000 total viewers, including just 55,000 in the 25-54 age group, according to the Daily Mail.     Biden Energy Loan Czar Awarded $1.6B Government Loan to Company Advised By His Current Business Partner

    Biden energy loan czar Jigar Shah signed off on a $1.6 billion taxpayer-funded loan last year that now appears to have directly benefited his current business partner, Jonathan Silver. Previously unreported corporate filings reviewed by the Washington Free Beacon show that Silver worked as a consultant for the project's developer after spending years on its board of directors. The Department of Energy's loan office, which Shah led between early 2021 and 2025, awarded the lucrative loan to New York-based Plug Power in May 2024 to help finance six of the company's planned green hydrogen production facilities. In one of his final moves before departing the office, Shah's team closed on the loan on Jan. 16, 2025. The timing of the loan disbursement means Silver served on Plug Power's board when the company negotiated with Shah's team and worked as a consultant when the loan was announced. In a disclosure Plug Power filed with the Securities and Exchange Commission in 2023, the company said Silver had resigned from its board of directors and entered into a 12-month consulting agreement with it that would be in effect until July 2024. Silver first joined the board of Plug Power in 2018. In that role, Silver earned a cash salary, stocks, and options totaling as much as $143,645 per year, additional filings showed. The revelation that Silver worked for Plug Power while the company engaged directly with Shah and his team at the Biden DOE raises key ethics questions in light of the pair's announcement last month that they would launch a green energy advisory firm together. In a LinkedIn post, Shah said he and Silver would help accelerate the growth of green energy startups in exchange for "modest equity stakes." In response to questions about how much they discussed Plug Power's loan with each other in their former positions, Shah and Silver denied having any interactions. Shah said he never worked directly on loans and that Plug Power applied for the loan before he joined, though records suggest his team encouraged the company to pursue the loan and he personally met with the company's CEO. "I didn’t work on the loans directly. I focused on building our team and getting folks to apply for loans," Shah told the Free Beacon. "Plug had already applied before I even joined LPO." Plug Power did submit the first part of its loan application with the DOE before Shah joined the loan office, but was invited to submit the second part of its application in April 2021, a month after Shah joined the office. And, one month after that, Shah personally met with Plug Power executives, according to a copy of his calendar obtained by the Free Beacon. "I had no involvement with Plug Power’s loan application and no interaction with either Jigar or the Loan Programs Office about the loan," Silver told the Free Beacon. "Our boutique advisory services firm does not interact with the loan program." The situation adds to questions about possible impropriety surrounding Plug Power's loan—the company has already faced scrutiny over its relationship to Shah. The Free Beacon reported last year that Shah invested $100 million in Plug Power through his former green energy-focused private equity firm prior to joining the Biden administration and Plug Power once described Shah's former firm as its "longstanding partner." "This is yet another glaring example of the revolving door between government power and green energy profiteering," Jason Isaac, the CEO of the American Energy Institute, told the Free Beacon. "The American people are footing the bill for an elite climate cartel that cycles in and out of Washington, doling out billions in taxpayer-backed loans to their future business partners." "The $1.6 billion Biden DOE loan to Plug Power reeks of the same Solyndra-style cronyism that defined the Obama era," he continued. "These backroom deals masquerading as ‘climate action’ should outrage every American who believes in accountability and fair markets." Silver served as the director of the DOE's Loan Programs Office during the Obama administration. In one of his first moves, Silver signed off on a $535 million loan to solar panel maker Solyndra, which then filed for bankruptcy just two years later. Solyndra has since become synonymous with wasteful federal spending. Michael Chamberlain, the director of conservative watchdog group Protect the Public’s Trust, added that Shah and Silver's relationship appears "very swampy." "This appears to be just the latest incident demonstrating why the American public’s trust in its government virtually disappeared during Shah's tenure," he said. Plug Power CEO Andy Marsh echoed Silver's comments, telling the Free Beacon, "Plug Power is not aware of any interactions Mr. Silver has had with the DOE related to Plug, either during his board tenure or under any subsequent consulting agreement." It's a precarious time for Marsh and Plug Power: The company continues to report less-than-stellar earnings and recently announced a fresh round of layoffs in a desperate attempt to save money. In 2024, Plug Power reported losses in excess of $2 billion, a year-over-year increase of 50 percent, and reported losses of nearly $197 million in the first quarter of 2025. Plug Power's poor financial performance means it would likely be unable to receive a $1.6 billion loan from private investors and highlights how the green energy industry is largely dependent on government grants, loans, and subsidies. As part of President Donald Trump's effort to cut spending and weed out waste from government, meanwhile, Energy Secretary Chris Wright is conducting a broad review of all of his agency's spending, including loans Shah's office doled out. Some reporting suggests hydrogen projects like Plug Power's are on the chopping block, though the DOE has downplayed those reports. Overall, the Biden DOE closed on 25 loans worth $61 billion and issued conditional commitments on loans for 27 projects worth $47 billion, according to a Free Beacon analysis of federal filings. According to the outlet: NewsNation exclusively spoke with a whistleblower from the U.S. Department of Agriculture about loan forgiveness policies under the Biden administration. The whistleblower discussed the passage of the American Rescue Act and how Section 1005 of that act provided loan relief specifically for socially disadvantaged farmers. The section provided race-based loan forgiveness, granted only to those who qualified as socially disadvantaged farmers or ranchers. I am no legal expert, but I am pretty sure this is not what you would call “legal.” Buried in the American Plan Rescue Act passed by a Democratic majority in Congress, the Secretary of Agriculture shall “provide payment in an amount up to 120 percent of the outstanding indebtedness of each socially disadvantaged farmer.” The “socially disadvantaged farmer” was defined by the act as American Indian, Alaskan Native, Asian, Black, African American, Native Hawaiian, Pacific Islander, Hispanic or Latino in order to qualify for their loan to be paid off, plus 20% to cover taxes. Do you know how evil someone has to be to provide payment based on nothing but skin color? Because I am pretty sure you do. What’s so disgusting about this is that there are so many people, despite the skin color they were born with, who could have benefited from this. However, in the pursuit of being politically correct, despite being morally incorrect, the Biden Administration decided to put their racist hats on and go against our founding principles. And to call that a slap in the face to the Civil Rights Act would be an understatement. James Dunlap owns a small family farm in Baker City, Oregon. He works two other jobs to keep his farm afloat, but he said he did not qualify for loan forgiveness because he’s white.     Docs Reveal Biden Admin. Coverup of COVID Vaccine Dangers as MAHA Report Calls for Safety Tests

    In the wake of an explosive Senate investigative report revealing that the Biden administration intentionally hid data from the public showing that the COVID vaccine was associated with serious health risks that resulted in hundreds of deaths, a new report from the Trump administration’s Make America Healthy Again Commission is calling for more robust safety tests to be conducted on vaccines. As reported by The Daily Wire on Wednesday, a report from the Senate Permanent Subcommittee on Investigations found that health officials within the Biden administration knew as early as February 2021 — within months of the release of the first COVID vaccine—that the shot was associated with myocarditis and pericarditis (inflammation of the heart) and that almost 1,000 deaths had been reported following vaccination, which were “often cardiovascular” in nature. However, the report noted that instead of informing the public about the deaths and the known health risks associated with the vaccine, U.S. health officials “downplayed the health concern” and intentionally “delayed informing the public about the risk” until June 2021 out of concern that the information would cause “vaccine hesitancy” in the public. The Senate report detailed how the Israeli Ministry of Health discovered the link between the vaccine and myocarditis sooner than U.S. officials because the shot had been rolled out in Israel earlier than in the U.S. Israeli officials notified Centers for Disease Control and Prevention (CDC) officials in February of “large reports of myocarditis, particularly in young people, following the administration of the Pfizer vaccine.” The Senate Subcommittee on Investigations was able to obtain 2,400 pages of documents through Freedom of Information Act (FOIA) requests in order to compile the report. “For a number of months, they were talking about these things. At some point in time, they actually internally said, ‘Is there a signal of myocarditis, a safety signal?’ And the answer was ‘Yes,’” Senator Ron Johnson (R-Wis.), who chairs the committee, told The Daily Wire. “And yet, a couple of days later, they decided not to issue a warning on the Health Alert Network (HAN).” “Rather than provide informed consent, the federal health agencies, the Biden administration, covered it up,” Johnson remarked. “They downplayed the signals. … [T]hey violated the inviolable principle of informed consent.” The documents were obtained through FOIA requests to the Trump administration, with the executive summary of the report noting that the Biden administration stonewalled Johnson’s committee when they requested the documents. Going forward, the Trump administration appears to be seeking far more transparency regarding vaccines than the Biden administration. On Thursday, the Make America Healthy Again (MAHA) Commission released a wide-ranging 73-page report on the underlying causes driving “the stark reality of American children’s declining health.” Under a section titled “The Overmedicalization of Our Kids,” the report highlights how, since 1986, “the number of recommended vaccines on the CDC childhood schedule has increased from 3 injections to 29 injections.” As the report goes on to note, this astronomical increase far outpaces the number of vaccines on the schedules of comparably developed European countries such as Denmark, which has about half as many. The MAHA report observes that “as with any medicine, vaccines can have side effects that must be balanced against their benefits.” However, the report continues, “Despite the growth of the childhood vaccine schedule, there has been limited scientific inquiry into the links between vaccines and chronic disease [and] the impacts of vaccine injury…” The report therefore calls for increasing the rigor of safety tests for vaccines, including the use of placebo-controlled trials, a “gold standard” method of safety testing that was not used to test the safety of the COVID vaccines. “Our understanding of vaccine safety and any links to chronic disease would benefit from more rigorous clinical trial designs, including the use of true placebos, larger sample sizes, and longer follow-up periods,” the MAHA Commission wrote. “Many vaccines on the CDC’s childhood schedule involved small participant groups, had no inert placebo-controlled trials, and had limited safety monitoring, some lasting six months or less—raising concerns about the ability to detect rare or long-term adverse effects.” Dr. Robert Malone, a physician and biochemist who conducted groundbreaking research on mRNA and DNA vaccines and became a prominent critic of the safety protocol shortfalls of the COVID vaccine, expressed cautious optimism about the MAHA report. “The report’s emphasis on transparency and prevention aligns with public health goals, but its cautious approach to pesticides and vaccines may reflect political compromises,” he wrote in a post on his Substack page Thursday. “… What happened today is critical.     Jake Tapper’s Own ‘Original Sin’

There’s a book that came out recently by Jake Tapper of CNN and Axios’ Alex Thompson called “Original Sin.” It’s about the cover-up, decline of former President Joe Biden and the disastrous choice of him choosing to run in 2024, until he was forcibly ejected from the ticket. We all have problems with this. And it’s essentially Jake Tapper—it’s a co-authored book but it’s Jake Tapper. Jake Tapper is a CNN grandee. Seven-figure salary. Kind of an iconic figure in this left-wing media outlook. But my point is this, for the last four years, again and again and again, if anybody questioned the obvious mental decline of Joe Biden—his cognitive difficulties—Jake Tapper, and went on CNN, Jake Tapper tore them apart. The locus classicus was Lara Trump, who said that he’s obviously—as early as 2020—in decline. And he suggested that she was berating him for a childhood stutter, which was absolutely ridiculous. So, what is my point? Here is someone who promulgated the greatest cover-up in the history of the U.S. presidency—helped. And we were told that Joe Biden “was fit as the fiddle.” We had medical reports that obviously or mysteriously did not have one critical indicator that were apparent on the Trump and Obama presidential medical records releases. There was no PSA test, an indicator of the health or malignancy of one’s prostate. That was a cover-up too, as we’re starting to learn. But my point is this, no one was more instrumental in berating—maybe Joe Scarborough, but other than he, Jake Tapper tore apart anybody who suggested that Joe Biden was as cognitive in decline as they saw with their own eyes and heard him. When The Wall Street Journal wrote in a definitive story, Jake Tapper wrote them off as Murdoch/Fox propagandists. So, why are we here? Why did he write a book now? Well, the obvious answer is that Joe Biden has no power. And these media people in Washington are—they’re like moths to a flame. They gravitate to power. And when you don’t have power, you don’t have friends. And there’s no downside in telling the truth. Why didn’t Jake Tapper write this a year ago? Because he knows what would’ve happened. Somebody in the White House would’ve called up and said, “Tapper, no one from CNN is gonna get a seat at a press conference. There’s not gonna be any CNN interview.” So he backed down. And now in a very cowardly fashion, now he comes out and he is blaming the White House cover-up. But what he doesn’t tell us is the White House cover-up would have been impossible had not CNN, MSNBC, PBS, NBC, ABC, CBS all conspired with the White House staff to downplay—not just downplay Biden’s cognitive decline but attack people. Bottom line: They had more interest in protecting this left-wing administration who was using this waxen effigy of Joe Biden and for someone’s purposes—we don’t know who was running the country, who was giving him the autopen executive orders. We have no idea who those people are. We have a suspicion that it was the Obama crowd. But nevertheless, they didn’t care about that. They did not care about that. All they knew is that this was a left-wing agenda and it had to be preserved by any means necessary. And that included lying, lying, covering up, and worst of all, demonizing and attacking people who sought to tell the truth about Joe Biden. And now, he wants to say—what? “I have a little humility. I may, may or not, I sort of, kind of was part of the cover-up. But now the real Jake Tapper is in this book, who’s now telling truth to power.” No, you’re telling truth to impotence. Joe Biden has got cancer. He is written off. He’s in decline. The family is disgraced. It’s easy now to write about that. It was hard and would have required intellectual courage, moral fortitude to say this when he was the most powerful man in the world. And so, Jake Tapper, you failed that test. And you should pay a penalty. CNN should look very carefully at whether they want to retain him because this is one of the greatest acts of duplicity, moral duplicity, I’ve seen in my entire life. And it joins a long, long, long list of collusion, capers, conspiracy, bogus, frauds, ruses. Jake Tapper, you should go back and see what was your position on Russian collusion? What was your position on Hunter Biden laptop disinformation? What was your position on the Steele dossier? What was your position on the 51 intelligence authorities? And I think in every one of those cases, you failed the test of truth and you really did this time in the greatest cover-up in the history, as I said, of the American presidency. And it’s not over yet because we’re gonna learn more and more, tragically, about Joe Biden’s medical condition and to see if not just whether the cognitive disabilities of Biden were covered up, but whether his prostate metastasized cancer contributed to that and that source was also covered up. Now, when Israel is executing a “final solution” in Gaza, when it is far too late for dissent to make any difference, the tide is slowly starting to turn. Now that Gaza is flattened, turned into mass graves and rubble, people who have kept quiet for the past 19 months are slowly starting to speak up. Now that Israel and the US are not even trying to pretend that they aren’t intent on emptying Gaza and the West Bank of Palestinians, of “taking control” of all of the land, some criticism has started to trickle in. Over in the UK, they’ve pulled out the “e” word. After 19 months of genocidal violence and almost three months of a starvation campaign the UK has decided to describe the situation as egregious. The UK, along with France and Canada, has threatened – and I’m sure Israel’s leaders are quaking in their boots over this – that there might be a “concrete” response if the mass killing and starvation continues.     Trump's FTC Chair Is Continuing To Push Lina Khan's Antitrust Ideology

    On February 26, new Federal Trade Commission (FTC) Chair Andrew Ferguson announced the creation of the Joint Labor Task Force, continuing former Chair Lina Khan's departure from what is known as the consumer welfare standard. Congress established the FTC in 1914 to prevent unfair competition and deceptive business practices. This has primarily meant "protecting Americans in their role as consumers," according to Ferguson. The FTC enforces the Clayton Antitrust Act, which outlawed price discrimination between customers, exclusive dealing, interlocking directorates, and mergers or acquisitions that "substantially reduce competition." But Khan was more interested in Americans' role as producers than consumers. In 2022 she signed a memorandum of understanding (MOU) with the National Labor Relations Board to "protect workers against unfair methods of competition, unfair or deceptive acts or practices, and unfair labor practices," such as restrictive contract provisions. In August 2023, Khan signed a similar MOU with the Department of Labor recognizing both agencies' shared commitment to protecting workers from deceptive earnings claims, restrictive noncompete and nondisclosure contracts, and the "impact of labor market concentration." Alden Abbott, the FTC's general counsel from 2018–2021, opposed the MOUs. Abbott argued in September 2023 that labor market oversight is "far-removed from the FTC's statutory mandate to focus on combating impediments to competition and consumer protection [and] would reduce the funding available to attack fraudulent and clearly anticompetitive acts." Khan's FTC went further, attempting to ban noncompete agreements in April 2024, describing them as an unfair method of competition in violation of the FTC Act. Ferguson dissented on legal grounds, arguing that the Commission does not possess the power "to declare categorically unlawful a species of contract that was lawful when the Federal Trade Commission Act was adopted." Though Ferguson opposed banning noncompetes, he still identifies them as one of 12 anticompetitive labor practices under FTC jurisdiction. Ferguson has directed his new Joint Labor Task Force to "prioritize investigation and prosecution" of such practices and to advocate regulatory and legislative changes that would address them. Ferguson's endorsement of the 2023 joint merger guidelines, along with his hostility to the tech industry and support for enforcing the anti–price discrimination Robinson-Patman Act, all suggest a continuation of Khan's activist antitrust ideology.     Trump Now Says Biden Was ‘Not for Open Borders,’ Blames ‘Thugs’ in His Administration

    For years, President Donald Trump has bashed his successor and predecessor, President Joe Biden, for his handling of the southern border, but on Tuesday, Trump said Biden “was not for open borders.” Biden “never talked about open borders, where criminals of all kinds, shapes, and sizes can flow into our country at will,” Trump wrote on Truth Social. “It wasn’t his idea to open the border, and almost destroy our country, and cost us hundreds of billions of dollars to get criminals out of our country, and go through the process we are going through now,” Trump said.   Estimates of more than 10 million illegal aliens entered the U.S. under the Biden administration, at least 663,000 of whom had either been convicted of a crime or faced criminal charges, according to U.S. Immigration and Customs Enforcement. The president instead laid blame for the mass influx of illegal immigration under the Biden administration at the feet of “the people that knew he was cognitively impaired, and that took over the autopen. They stole the presidency of the United States, and put us in great danger. This is treason at the highest level! They did it to destroy our country.” The 47th president has previously questioned the use of the autopen during the Biden administration to sign executive orders and pardons. Trump made border and immigration issues a pillar of his 2024 presidential campaign, repeatedly criticizing Biden for his border policies.   “We have a border that’s the most dangerous place anywhere in the world. … And he opened it up, and these killers are coming into our country,” Trump said of Biden during the 2024 presidential debate last June.   Now, Trump says that the “Joe Biden that everybody knew would never allow drug dealers, gang members, and the mentally insane to come into our country, totally unchecked and unvetted. All anyone has to do is look up his record. Something very severe should happen to these treasonous thugs that wanted to destroy our country, but couldn’t, because I came along.” Trump’s redirection of blame for the Biden administration’s border policies follow the release of two pieces of information related to Biden’s health. On Saturday, Axios published the complete audio recordings of Biden’s interviews with special counsel Robert Hur. The interviews took place over two days, Oct. 8 and 9, 2023, and reveal multiple instances in which Biden appears to struggle to recall certain details about his life. Hur interviewed Biden as part of the probe over Biden’s handling of classified documents.     Undoing Decades of Administrative State Tyranny

    President Donald Trump and the Department of Government Efficiency have made great headway in slashing regulations, but this work could be short-lived unless Congress makes these changes permanent.  For 40 years, the Chevron doctrine, also known as Chevron deference after a 1984 Supreme Court decision, has empowered the administrative state to extend the power of the federal government further and further over the lives of Americans. This made doing business in the United States extremely difficult and has cost our economy as a whole a fortune.   Regulatory costs skyrocketed under the Biden-Harris administration. In just four years, federal agencies reported that the cumulative total of the cost for individuals and businesses to comply with regulations under the administration added up to more than $1.8 trillion. Even more egregious, in 2024, federal agencies imposed almost 92 million hours of paperwork on the American people and added over 107,000 pages of rules to the Federal Register, according to the American Action Forum. There is no way to calculate how much 92 million hours of paperwork will cost American business owners and their customers —but I can assure you, it’s too much. The administrative state is out of control. Part of the reason can be traced back to the use of the Chevron doctrine. Fortunately, it was overturned in June of last year, but there is now 40 years of red tape to unravel.  The Chevron doctrine held for decades that if a federal regulation was challenged, federal courts should defer to the agency’s interpretation of the law the regulation was based on. The only checks on this doctrine were that the interpretation should be “reasonable” and that the question wasn’t directly addressed in the text of the law itself. Obviously, this opened the door to a flurry of issues. One presidential administration’s definition of “reasonable” differed vastly from another.  Since this case was decided in 1984, the power of the executive branch has grown exponentially, usurping the lawmaking role of Congress and the judicial discretion of the courts. Since these rulemaking agencies are under the executive branch, multiple presidents have used Chevron deference and other tactics to manipulate laws passed by Congress to serve their own political agenda. For example, President Joe Biden grossly overstepped his authority when he issued a “90-day pause,” which lasted for over 200 days, on the issuance of new firearm export licenses. The policy stonewalled license applications for months, devastating American business owners. The Biden-Harris administration also stretched agency authority beyond the limits to forgive massive amounts of student loan debt that it actually didn’t have the authority to forgive. It’s time to roll back this administrative tyranny.   For decades, Chevron deference significantly eroded the separation of powers among the three branches of government, undermining the checks and balances vital to our constitutional system. In an 1817 letter to John Adams, James Madison wrote, “The great question now to be decided … is, whether checks and balances sufficient for the purposes of order, justice, and the general good may not be created by a proper division and distribution of power among different bodies.” Our Founding Fathers believed that tyranny results from power residing in one place. That’s why they were intentional about separating it. However, Chevron deference allowed executive agencies to shape, execute, and adjudicate laws—creating an unhealthy level of concentrated power within the bureaucracy and the executive branch. Allowing federal agencies to act like lawmakers is exactly what our Founders attempted to avoid when they decentralized power.  One particularly heinous example of bureaucratic overreach was when the Biden-Harris administration attempted to radically expand the Waters of the United States rule. Under this expansion, the Environmental Protection Agency would have been given the power to override the property rights of Americans with ponds on their property or even ditches that collected rainwater. It would have prevented farmers from taking care of their own land, even regulating how close they could mow a patch of grass adjacent to a ditch. According to Steve May, a farmer in Humphreys County, Tennessee, “Farmers are stewards of the land and water. They want to see that it’s protected and conserved. Overregulation leads to unknowns that cripple farmers’ ability to plan.”  Steve Hargrove, a beef cattle producer in Benton County, agreed and told my office:  “My concern is that the government is going to try to take over not only the creeks, but the ponds on my farm, too. I’m concerned I won’t be allowed to keep these bodies of water clear. And if I’m forced by this rule to let these creeks and streams go wild, it will affect my land. It could cause drainage problems in the field. I could lose ground, and that affects my way of life.”  Had this Waters of the United States rule-change been enacted, it would have been the end to true property rights in America.  Under the rule of Chevron, the deck was always stacked against everyday Americans. Consider that agencies won 71% of all cases where their regulations were challenged—and 93.8% of ambiguous cases. This gave an unfair advantage to federal agencies and ensured that true congressional intent and the will of the American people didn’t stand a chance. Representative government is the cornerstone of our constitutional system, but when that accountability is missing, abuse follows.  Consider how the Biden-Harris administration’s Bureau of Alcohol, Tobacco, Firearms, and Explosives treated gun shop owners. Tactical Edge LLC, a veteran-run gun shop in my hometown of Clarksville, had its federal firearms license revoked for minor paperwork errors. Bobby James, one of Tactical Edge’s owners, told my office, “This was all politics. They’re closing down gun shops so Americans can’t get guns.” Tactical Edge filed an appeal with the ATF and lost. It spent $60,000 on lawyer’s fees. James said, “For small businesses, there is not enough money to compete with the budget of the federal government and the ATF’s numerous elite lawyers.” As a result, Tactical Edge was forced to lay off most of its employees, many of whom were veterans. Though the Trump administration has now rescinded Biden’s “Zero Tolerance Policy,” gun shops like Tactical Edge have yet to get their licenses back. As a result, Tactical Edge has lost 80% of its business.  These are just a few stories of how government overreach has impacted real Americans, but there are many more. To protect Americans and American businesses from government tyranny, I introduced the Sunset Chevron Act. This bill would force all executive agency actions that have been upheld by the courts because of Chevron deference to sunset—unless they were upheld by subsequent congressional action. Every agency would be required to compile a list of all such rules in chronological order of implementation. Then, in order of most recent to least recent, each agency would sunset a different rule every 30 days. This would right 40 years of executive overreach.  Our Founding Fathers believed that the executive branch should execute the law, the legislative branch should write the law, and the courts should interpret the law.     The Timing of Biden’s Cancer Announcement Is Suspicious

We had a bombshell report this week that former President Joe Biden—not more than, oh, 100-plus days into the Trump administration—his office has just announced that he has prostate cancer, and we wish him well. And it’s very sad, though, because this is not just an age-related, slow-growing prostate cancer that we hear about, that it’s somewhat easily treatable. It’s a very aggressive, malignant type. And apparently, it’s already in his bone marrow and he is going to have to take some very severe medicines and chemotherapy. But it poses a lot of strange questions. This announcement came right on the eve of Jake Tapper’s co-authored book, basically, that is promised to be a bombshell revelation, that there was a cover-up by the Biden team, headed by Jill Biden and Ron Klain and others in the administrative staff of the White House. But the media was complicit too. And of course, Jake Tapper is quite embarrassed because when he’s accusing the media of being complicit, no one was more complicit in this effort to hide the true medical condition than was Jake Tapper. So, these are the questions that we’re stuck with: Why did Joe Biden’s medical team announce right now—right on the eve of the release of this book—this shocking story that the president who just left office 100 days ago was suffering from a very serious, rare, malignant form of prostate cancer? This doesn’t just develop immediately. The vice president, the president—he was vice president, he was president, now he’s an ex-president. They are accorded the best, most comprehensive diagnostic medical care in the world. Isn’t it true that Joe Biden would’ve known about this? We just had a report—right before he stepped down, in the summer of 2024—an exhaustive medical report, that he was fine. But he is trying to tell us or sadly, his team is trying to tell us that, just in a matter of nine months, he developed a prostate cancer unknown to all of his doctors. Unknown—that didn’t appear on any of his diagnostic tests. And was advanced to the point that it may be fatal. And why would he not announce that last week, two months ago, six months ago? Do we really believe that he just found out right now? The report said that he had symptomology of it. Usually when you have prostate cancer, at least in the initial months, you don’t have symptoms. But if he had symptomology, why didn’t the doctors test and announce this very much earlier? So, this is an enigma. And we don’t really know what’s going on. But if you were a cynic, you would say the medical announcement was designed to detract from the bombshell book that will come out describing this historic conspiracy to hide Biden’s medical condition. There’s other peripheral subtext to this story, and that is some of the treatment for advanced prostate cancer may have side effects. And some of the side effects may be anything from vertigo to fatigue to mental confusion. So, it’s incumbent upon his doctor and his medical team to explain to the nation were any of Joe Biden’s symptoms that were so obvious in May and June of 2024, but even earlier—and I had written, among others, way back in 2020—were any of these symptoms related either to a known prostate cancer or a known prostate cancer treatment that he was undergoing at the time? Were these the side effects? And more importantly, if you’re going to announce this tragic news, we need to know when it was discovered because the implication is that just suddenly he had problems and then he got a sudden diagnosis and then he immediately announced it. But it doesn’t seem true with such an aggressive cancer that can’t just appear out of nowhere in a week or two. So, we have more questions than answers. We wish Joe Biden well. We hope that he has a rapid recovery. But the mystery of his physical and cognitive health, while he was president and even before when he was nominated in that mysterious primary process of 2020, now continues into his ex-presidency. And there’s one narrative through this entire tragedy. And that is no one, no one comes forward—not the media, not the Biden family, not the Biden handlers in the White House, and not the Biden medical team—and just simply sits down with the American people and says, “This was the true state of Joe Biden’s health. This is when we actually learned about this prostate problem that may be terminal, to be frank. And these were the people who were operating in the White House as auxiliaries and subordinates to help Joe Biden get through his term.” Until we find out that truth, there’s going to be more mystery than answers.
